Handling the preparation and showing of their home is an easy task for the majority of sellers. They feel most qualified to answer buyers questions. Who knows the home better than the owner? However, when it comes to negotiating some sellers prefer having an attorney handle the negotiations and paperwork.
Every seller should have an attorney represent them from the acceptance of the offer through the closing. Dealing with negotiations before acceptance of an offer can be stressful for some sellers. If a real estate agent is representing the buyer they are experienced in negotiating and may make the seller feel uncomfortable. Keep in mind that the agent is working for a commission and the buyer's interest, not the seller. Counter offers, contingencies, problem with the home inspection or delays in mortgage approval are best handled by an attorney. Having an attorney will protect you in every way and be sure that paperwork and legal requirements are met.
Being able to say to a perspective buyer that your attorney will have to review the offer also puts you in control even when you may be dealing with an experienced negotiator. Using an attorney for negotiations will prevent any poor decisions that your emotions might influence. The buyer will realize that any condition you might mention will have to be approved by the attorney.
If you feel somewhat uncomfortable or stressful on how to handle the negotiating process it is wise to have an attorney take over. The cost of hiring an attorney is not expensive when you consider the emotional relief knowing that an expert is looking out for your protection.
